The Delhi High Court in the case is informed by the Delhi Government that no permission in the case will be granted to any individual for felling of trees in the national capital till September 14, 2023.
The bench headed by Justice Jasmeet Singh was informed by the Delhi Government that any permission required for important projects will be intimated to the court.
The counsel, Advocate Dhairya Gupta appearing for the Delhi Government submitted before the court that in a plea moved seeking contempt action against the officials for not following court directions passed in April last year requiring the Tree Officers to spell out reasons for permitting the felling of trees in Delhi.
The present petition relates to the issue of preservation of trees in the national capital.
In the present case, an application is moved by the petitioner wherein seeking early hearing of the matter submitting that despite of the last year’s order, the authorities are recklessly granting permission for felling of trees.
The bench headed by Justice Singh stated that perusal of the permissions granted by the officers for felling of trees ‘seems to suggest’ that there is the total non-application of mind, while granting such permissions.
The court in its order stated that some of the permissions how that the trees have been permitted to be cut for individuals requiring parking spaces for their vehicles.
The court in the case observed and has directed the authorities to bring the files which pertains to granting of permissions of the trees that have been felled, as per the urgent application.
Further, it has been observed by the said court that Mr Gupta states that till the next date of hearing no permission for felling of trees for any individuals will be granted and any permission which is required for important projects will be intimated to the Court.
The bench headed by Retired Justice Najmi Waziri directed Delhi’s Principal Chief Conservator of Forests for ensuring that the orders permitting the tree felling, under Delhi Preservation Of Trees Act, 1994, are uploaded within the period of 48 hours on the official website.
Accordingly, the court listed the matter to be next heard on September 14, 2023.
